Family Support

The Clackamas County District Attorney’s provides services to ensure children and families receive financial support.

Our office represents the interests of the State of Oregon. We do not represent either party. For legal advice please contact your private attorney.

Our office cannot guarantee that you will receive regular and timely support payments; however we will make all reasonable efforts to assist you.

When you apply for services the non-custodial parent will be advised to stop making payments directly to you, and instead, make payments through the Child Support Program.

Each case is different, with its own set of facts and circumstances. Most of our processes are handled administratively (outside of court) and take a minimum of 90 days. If hearings are requested, a party is difficult to serve, or if paternity testing is requested it can take up to six months or longer.

Services Provided

  • Establishment of Paternity
    Either parent may apply to establish paternity.  If the parents do not agree on the issue of paternity we will schedule a paternity test.
  • Establishment of child support including health care coverage and cash medical support 
    An order can be established that requires the non-custodial parent(s) to pay child support.  Either parent can also be ordered to provide health care coverage.  Cash medical support can be ordered for the costs of recurring out of pocket medical expenses and/or for repayment towards the cost of public health care coverage
  • Modification of an existing order
    Either parent/party may request a review of the amount of an existing support order:
    • 35 months after the date of the most recent support order or
    • When the parent/party can prove there has been a substantial change of circumstances since the last order.
  • Interstate
    • When the parent who is ordered to pay support lives in another state we will request that the other state help collect the support. 
    • We can also assist a parent/party in another state collect support from a parent who lives in Oregon
  • Enforcement
    There are a variety of enforcement tools that may be used which can include:

    • Withholding income, wages or other benefits such as unemployment compensation, worker’s compensation or retirement benefits.
    • Credit Bureau Reporting
    • Passport Restriction
    • Interception of State and Federal tax refunds
    • Suspension of Oregon licenses including driver, occupational and recreational licenses.
    • Garnishment of bank accounts, estates or lottery winnings 
    • Financial Debtor Examinations
    • Contempt for non payment of support that can include an arrest warrant
    • Criminal Non Support 

Services Not Provided

  • Legal advice
  • Enforcement or collection on spousal only orders
  • Collection on unreimbursed medical bills
  • Mediation, parenting time and custody assistance

How can I help expedite the processing of my case?

  • Notify us of any change in address, telephone or employer for yourself or the other party.
  • When requested provide signed copies of all support orders.  Certified copies are required for some processes.
  • Keep our office advised on any legal proceedings or orders that are taken.
  • Advise our office if your child legally emancipates, joins the military, marries, is adopted or is no longer attending school.

How long will the process take?

The more information you provide to us, the better equipped we are to assist you.  Our efforts may take longer and may not be as successful if the non-custodial parent  has moved out of state or to an unknown address

  • frequently moves from job to job;
  • works for cash pay instead of reported earnings;
  • is self-employed
  • is incarcerated

What happens if my child is no longer attending school?

Child support will continue to age 18 regardless of school enrollment.  Oregon law provides support will continue to age 21 if the child is attending school.  It is child’s responsibility to notify the State and the non custodial parent if they are no longer attending school.  If you are the non custodial parent and believe your child is not attending school you can submit a written objection to our office or FAX it directly to the Child Attending School Team (CAST) at 503 945-0543
